No Pretrial Bail for Indefinite Periods: Appeals Division

Khairul Alam: The Appeals Division has issued remarks stating that granting pretrial bail for an indefinite period to any individual or group is not deemed appropriate.

In a recent order concerning the bail of two BNP leaders in a case related to vandalism in Ramna Thana, the Appeals Division articulated this opinion. The order, led by Chief Justice Obaidul Hassan and two other judges, was published on Saturday on the Supreme Court’s website.

Referring to several previous judgments, the order emphasized that according to the policies outlined in these judgments, it is not advisable for individuals or groups to be granted pretrial bail for an unspecified duration.

The High Court Division and the Appeals Division have struggled to adhere to the policy outlined in their judgments due to the potential delay in conducting thorough investigations by investigative agencies.

In this context, individuals are not entitled to the benefits of pretrial bail until the submission of a proper investigation report by the concerned authorities.

This stance underlines the necessity of upholding legal procedures and ensuring that justice is served effectively, even amidst procedural challenges.
