Supreme Court of Bangladesh upholding the High Court verdict declaring the Dr. Yunus-led interim government legal

Shakil Talukder from High Court : The High Court’s ruling that the interim government, formed according to the Supreme Court’s reference, is valid has been upheld. Today, Thursday (4 December), the Appellate Division of the Supreme Court delivered the final order, keeping the High Court verdict in force.

A full bench of seven judges, headed by Chief Justice Dr. Syed Refaat Ahmed, announced the decision. The court rejected the leave-to-appeal petition that challenged the High Court verdict.

Earlier, on Wednesday (3 December), the court fixed today for the order after completing the hearing. Attorney General Md. Asaduzzaman and Additional Attorney General Barrister Anik R. Haque represented the state. Advocate Mohsin Rashid argued for the petition, while Barrister Ruhul Quddus Kajol and Advocate Mohammad Shishir Monir participated as interveners.

The leave-to-appeal hearing began on Tuesday (2 December). During the hearing, lawyer Shishir Monir argued that the legitimacy of any government comes from public trust and acceptance.

On 12 November, senior lawyer Mohammad Mohsin Rashid made submissions before the court. Later, he faced a contempt allegation from the Attorney General for making adverse remarks about the court. The Appellate Division asked him for an explanation.

Last December, Mohsin Rashid filed the initial writ petition in the High Court challenging the legality of the interim government’s oath. The High Court dismissed the writ, stating that since the people have accepted the interim government, there is no scope to question its legitimacy. After that, he sought permission from the Appellate Division to appeal.
